Please read these Terms of Service ("Terms") carefully before using Paper Kites POS ("the Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

Paper Kites POS is a web-based point-of-sale application for small businesses. A free tier is available with no account required. A Pro subscription unlocks advanced analytics and additional features.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using Paper Kites, you represent that you meet these requirements.

3. Accounts

Pro subscribers must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@paperkitespos.com if you suspect unauthorised access.

4. Subscriptions and Billing

  • Pro subscriptions are billed monthly ($29.99/month) or annually ($299.90/year).
  • Payments are processed securely by Stripe, Inc.
  • Subscriptions renew automatically at the end of each billing period unless cancelled.
  • You may cancel at any time via your account settings or by emailing support@paperkitespos.com.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to process fraudulent transactions
  • Resell or sublicense access to the Service without our written consent

6. Data Ownership

All product, sales, and business data you enter into Paper Kites remains yours. We claim no ownership over your data. Free-tier data is stored locally on your device; Pro data may be synced to our servers to enable cross-device access.

7. Intellectual Property

The Paper Kites name, logo, software, and all associated content are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written permission.

8. Availability and Modifications

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practical.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

10. Limitation of Liability

To the maximum extent permitted by law, Paper Kites shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including loss of revenue, data, or business opportunities.

11. Governing Law

These Terms are governed by the laws of the applicable jurisdiction. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.

12. Changes to These Terms

We may update these Terms at any time. We will notify you by email or in-app notice before changes take effect. Continued use of the Service after the effective date constitutes acceptance.
